Conditions of Sale
1. Some of the lots in this sale are offered subject to a reserve. This reserve is a confidential minimum price agreed upon by the consignor & COPAKE AUCTION below which the lot will not be sold. In any event when a lot is subject to a reserve, the auctioneer may reject any bid not adequate to the value of the lot.
2. All items are sold "as is" and neither the auctioneer nor the consignor makes any warranties or representations of any kind with respect to the items, and in no event shall they be responsible for the correctness of the catalogue or other description of the physical condition, size, quality, rarity, importance, medium, provenance, period, source, origin or historical relevance of the items and no statement anywhere, whether oral or written, shall be deemed such a warranty or representation. Prospective bidders should inspect the merchandise thoroughly before bidding to determine its condition, size and whether or not it has been repaired or restored. All sales are final & refunds will not be given.
3. The auctioneer reserves the right to withdraw any merchandise before the sale and shall have no liability whatsoever for such withdrawal.
4. The auctioneer will be the final judge as to who is the successful bidder. In the event of any dispute the auctioneer shall at his discretion decide to reopen the bidding or not.
5. As a service to our customers the COPAKE AUCTION will execute absentee bids if so authorized in writing. Absentee bids should be made on the Bidder Form available in the office. This form should be clearly and completely filled out. All absentee bids will be executed competitively during the sale. Items will be purchased for the lowest price possible regardless of the amount of the order bid. Where two absentee bidders bid the same amount the first received will be honored. This service is offered as a convenience and COPAKE AUCTION will not be responsible for any errors or failures to properly execute the bids.
6. On the fall of the auctioneers hammer, ownership to the offered lot will pass to the highest bidder acknowledged by the auctioneer, and as such the bidder assumes full risk and responsibility and will pay the full purchase price of the item (s).
7. All items are subject to a 15% buyers premium (2% discount for cash or check) which will be added to the successful bid price and is payable by the purchaser as part of the total purchase price.
8. All items are subject to an 8% sales tax unless the purchaser possesses a sales tax exemption number.
9. All accounts are to be settled by the end of the sale. We do not accept checks from first time buyers unless accompanied with a bank letter of credit or previous approval from the auctioneer. Payment may also be made by cash, Travelers Checks, MasterCard or Visa.
10. All property must be removed from the premises by 10:00 am on the following day after the sale unless other arrangements have been made with the auctioneer. If items are not removed 14 days after the date of sale a storage fee of one dollar per day will be charged to the purchaser of said item (s). In addition items not removed from the premises eight weeks after date of sale will be resold at auction. The COPAKE AUCTION shall have no liability for any damage to property left on its premises.
11. The COPAKE AUCTION may at its discretion and at purchaser's request package and ship items as directed by the purchaser. In such event, purchaser agrees that all such packaging, handling and shipping is at the sole risk of the purchaser and that COPAKE AUCTION shall have no liability for any loss or damage to items. Purchaser shall pay in advance all packaging expenses including labor, materials, postage and carrier fees and all insurance charges.
12. Bidding on any item indicates your acceptance of these terms and all other terms announced at the Auction Gallery.

1) Please contact us to discuss the commission for your consignment 518-329-1142.
2) The consignor will be paid (30) days after the day of sale.
3) We charge a 15% buyers premium (2% discount for cash or check) on top of the hammer price as indicated in our Conditions of Sale.
4) A confirmation list of lots will be supplied to the consignor by Copake Auction.
5) Once a lot is submitted for auction it may not be withdrawn unless a $ 50.00 withdrawal fee is paid.
6) Coverage for loss, theft, or damage of property will be incurred by the consignor unless an insurance fee of 3% of the "value" is paid by the consignor. The "value" of each lot must be indicated by the consignor and agreed upon with the auctioneer when submitted for auction. This "value" will be used for insurance purposes and repayment to consignor if goods are lost or damaged.
7) All property will be sold without reserve unless agreed to in writing prior to the sale. Should a lot not reach a reserve price the consignor will be charged $25.00 per lot.
8) Advertising of lots will be done at the discretion and expense of Copake Auction. The consignor may request to have photographs of their item(s) included in Copake Auction advertisements but must pay a $25.00 fee per photograph for this service.
9) The consignor represents and warrants that he/she is the sole owner of the property to be consigned and sold by the Copake Auction and that he/she has the full legal right to sell or cause the property to be sold; that the property is and will remain free of liens; and that the clear title and right to possess the property will pass to the buyer. The consignor holds Copake Auction harmless from any claims, damages or expenses, including legal fees, arising out of any failure or breach of their representations and warranties.
10) The consignor authorizes Copake Auction to accept the return and to rescind the sale of any property without limitation, at our discretion. If we in our best discretion believe a) that an item is defective, b) an item is not genuine, c) that any property is not "as represented" in our description, d) that the offer/sale of the property may subject us and/or the consignor to any liability by the buyer, we will rescind the sale. In such an event, the consignor agrees to reimburse Copake Auction in an amount equal to what was originally paid to the consignor for the said item. The property will then be returned to the consignor.
11) Catalog descriptions of lots will be written by or approved by Copake Auction. Any "grouping" of consignor lots will be at the discretion of the auctioneer. Also at the auctioneers discretion will be the placement of items featured in the catalog and the use (or not) of photographs of the items in the catalog.
12) We will make no guarantee or warranty as to the final selling price of any item. Estimated values by us shall not be deemed as any such guarantee or warranty.
Instructions for Absentee & Phone Bidding
Absentee Bids: / Top of Page
1) Bidder must fill in the spaces provided on the bid form with
the following information: a) lot number of the item to be bid on; b) description
of the item (e.g. set of [6] chairs, cupboard, etc.); c) bid price (this
is the highest amount you are willing to pay for the item); d) name, address,
and phone number; e) resale number (if applicable). Please sign and date
the bottom of the bid form.
2) All bids are executed as competitively as possible. The item(s)
will not necessarily sell for the absentee bid price, but will sell one
increment over the last bid on the floor, or any other absentee bids.
3) In the event of tie absentee bids, the first bid received
will take precedence. Bidders may want to leave an odd number bid (e.g.
$55 as opposed to $50).
4) If you are successful on an absentee bid, the Copake Auction
will contact you the Monday following the sale date (please be sure to
give us a telephone number where we can reach you on weekdays). Payment
is expected immediately and arrangements for pick up or delivery can be
made at this point.
Phone Bidding: / Top of Page
1) Before arranging a phone bid the prospective bidder must
first be approved for phone bidding.
2) The same form and information are then filled out as in the
above mentioned instructions for absentee bidding with the exception of
the bid price (instead enter PHONE BID). In addition a Visa or Mastercard
number may be taken (when necessary).
3) Copake Auction will have a member of our staff contact
the phone bidder at the specified telephone number during the auction.
Items are sold in consecutive catalog order at a rate of approximately
100 per hour (please allow for "A" lots and uncataloged items). When the
item is offered for sale the phone bidder will bid against the audience
and any absentee bids with the assistance of our staff.
4) Successful phone bidders will also be expected to pay the
week following the auction and arrangements for pick up or delivery will
be made at that time.
*Payment for successful absentee and phone bids is expected within
(10) business days. Items not paid for in a prompt manner will be returned
to consignor or resold, and bidder loses their right to compete in future
auctions.*

Successful bidders must arrange for removal of their property, or for
shipping, if necessary. Because costs of shipping can vary widely, we recommend
inquiring about an estimate before bidding on items. All labor and materials
required for preparation and packing of property, insurance (based on the
hammer price of each lot purchased), shipping and any other related shipping
expenses are the responsibility of the buyer and must be paid in advance
of shipping. Allow several weeks for delivery.
